Welcome to NIXIVA. These Terms of Service (“Terms”) govern your access to and use of the NIXIVA website, online store, products, services, features, and other offerings (collectively, the “Services”).

Throughout these Terms, “NIXIVA,” “we,” “us,” and “our” refer to NIXIVA and its applicable owners, operators, affiliates, and representatives. “You” and “your” refer to any person accessing our website, purchasing our products, or otherwise using our Services.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.

By visiting our website, creating an account, placing an order, purchasing a product, or otherwise using our Services, you agree to these Terms and any additional policies referenced in them.

If you do not agree to these Terms, you should not use our Services.

1. Eligibility

By using our Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian where required.

You may not use our products or Services for unlawful or unauthorized purposes.

You may not violate applicable laws or regulations while using our Services.

2. Online Store Terms

We reserve the right to refuse service to anyone to the extent permitted by applicable law.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, or otherwise commercially use any portion of our Services without our express written permission.

You are responsible for maintaining the confidentiality of any account information and passwords associated with your account.

3. Products

NIXIVA offers pet products, including freeze-dried dog treats and related products.

We make reasonable efforts to accurately display and describe our products, including their ingredients, weights, packaging, appearance, and other characteristics.

However, actual products may have natural variations in:

  • Color

  • Shape

  • Size

  • Texture

  • Aroma

  • Weight distribution

  • Appearance

These variations are particularly normal with natural, single-ingredient, and freeze-dried products and generally do not indicate a product defect.

Product packaging, labeling, designs, colors, sizes, ingredients, sourcing, specifications, and availability may change from time to time.

Always review the actual product packaging before feeding a product to your pet.

4. Product Images

We make reasonable efforts to display our products accurately.

Photographs, illustrations, digital renderings, promotional images, packaging mockups, and other visual representations appearing on our website or advertising may differ somewhat from the product you receive.

Screen settings, lighting, photography, natural product variation, packaging updates, and other factors may affect how a product appears.

5. Pet Health & Feeding

NIXIVA products are intended for use as pet treats or as otherwise indicated on the applicable product packaging.

Unless specifically stated otherwise, our treats are not intended to provide complete and balanced nutrition or replace your dog's regular diet.

Treats should be fed responsibly and in appropriate quantities based on your dog's size, age, activity level, overall diet, and individual needs.

Always provide your dog with access to fresh drinking water.

You are responsible for determining whether a product is appropriate for your pet.

6. Veterinary Disclaimer

Information provided by NIXIVA through our website, packaging, advertising, social media, emails, customer service, or other communications is provided for general informational purposes only.

It is not veterinary advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Consult a qualified veterinarian regarding your pet's health, diet, allergies, medical conditions, or specific nutritional needs.

If your pet experiences an unexpected or concerning reaction after consuming a product, discontinue use and contact your veterinarian.

7. Allergies & Sensitivities

Pet food sensitivities and allergies can vary between individual animals.

You are responsible for reviewing product ingredients before giving a product to your pet.

If your pet has known or suspected food allergies, sensitivities, dietary restrictions, medical conditions, or special nutritional requirements, consult your veterinarian before introducing a new product.

8. Safe Handling & Storage

Customers are responsible for following storage, feeding, and handling instructions provided on product packaging.

Keep products properly sealed and stored as directed.

Do not feed a product if its packaging or safety seal appears opened, compromised, contaminated, tampered with, or significantly damaged.

Keep treats and packaging materials away from children where appropriate.

9. Pricing

Product prices are displayed on our website and are subject to change without notice.

We reserve the right to modify prices, promotions, product offerings, shipping charges, or other fees at any time.

Price changes will not normally affect an order that has already been successfully placed and accepted, except where permitted by law or where an obvious pricing error has occurred.

Applicable taxes and shipping charges may be added at checkout.

10. Orders

Submitting an order does not necessarily mean that NIXIVA has accepted the order.

We reserve the right to accept, decline, limit, hold, or cancel an order when reasonably necessary, including because of:

  • Product availability

  • Inventory errors

  • Pricing or listing errors

  • Payment problems

  • Suspected fraud

  • Address verification issues

  • Order quantity limitations

  • Technical errors

  • Compliance or legal requirements

If we cancel an order after payment has been successfully collected, we will issue an applicable refund.

11. Accuracy of Billing & Account Information

You agree to provide current, complete, and accurate purchase and account information.

This includes your name, billing information, email address, shipping address, and other information reasonably required to process your order.

You agree to promptly update your information when necessary.

NIXIVA is not responsible for delays or failed deliveries resulting from inaccurate information provided by the customer, subject to applicable law.

12. Payment

Payment must be successfully authorized before an order can be completed.

Available payment methods are displayed during checkout and may change from time to time.

Payment processing may be performed by third-party payment providers. Your use of those services may also be subject to their applicable terms and privacy practices.

13. Shipping

Orders are subject to our separate Shipping Policy.

Our Shipping Policy includes information concerning order processing, carriers, tracking, delivery, incorrect addresses, damaged shipments, missing packages, and related matters.

By placing an order requiring shipment, you agree to the applicable provisions of our Shipping Policy.

14. Returns, Refunds & Product Issues

Returns, refunds, replacements, damaged products, incorrect products, and other purchase-related issues are governed by our separate Return & Refund Policy.

Because NIXIVA sells consumable pet products, certain products may not be eligible for return after they have been opened, used, or had their safety seal compromised, except where required by applicable law or where NIXIVA determines that a refund or replacement is appropriate.

15. Promotions & Discount Codes

From time to time, NIXIVA may offer:

  • Discount codes

  • First-order discounts

  • Free shipping

  • Bundles

  • Giveaways

  • Promotional pricing

  • Affiliate or ambassador codes

  • Limited-time offers

  • Other promotions

Promotions may be subject to additional conditions.

Unless otherwise stated, promotional offers cannot be combined.

Discounts generally have no cash value and cannot be exchanged for cash.

We reserve the right to modify, suspend, cancel, or refuse a promotion where reasonably necessary, including in cases of fraud, abuse, technical errors, duplicate accounts, or violation of promotional terms.

16. Affiliate Partners, Influencers & Brand Ambassadors

NIXIVA may work with third parties who promote our products, including individuals or businesses referred to as affiliates, affiliate partners, influencers, creators, brand ambassadors, ambassadors, referral partners, or similar terms.

These partners may receive commissions, free products, discounts, compensation, or other benefits in connection with their promotion of NIXIVA.

Participation in the NIXIVA affiliate, influencer, creator, or brand ambassador program is subject to our separate Affiliate Policy and any additional agreement or program terms provided to the participant.

The Affiliate Policy governs matters such as eligibility, commissions, referral tracking, promotional conduct, required disclosures, intellectual property, prohibited advertising practices, termination, and payment.

Nothing in these Terms creates an employment, agency, partnership, joint venture, franchise, or other similar relationship between NIXIVA and an affiliate, influencer, creator, or brand ambassador.

Affiliate partners are independent parties unless a separate written agreement expressly provides otherwise.

17. Affiliate Disclosures

Affiliates, influencers, creators, and brand ambassadors are responsible for clearly and conspicuously disclosing their relationship with NIXIVA when required by applicable advertising, endorsement, consumer-protection, or other laws and regulations.

NIXIVA does not authorize partners to make false, misleading, unsubstantiated, or unauthorized claims about NIXIVA products.

Additional requirements are contained in our Affiliate Policy.

18. Reviews, Photos & User Content

You may have opportunities to submit product reviews, photographs, videos, comments, testimonials, social media content, or other material (“User Content”).

You retain ownership of your original User Content.

When you voluntarily submit User Content directly to NIXIVA for publication, you grant NIXIVA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content in connection with operating, marketing, and promoting NIXIVA and its products, subject to applicable law.

You represent that you have the necessary rights to content you submit and that it does not violate another person's intellectual property, privacy, publicity, or other rights.

We reserve the right to moderate or remove User Content to the extent permitted by applicable law and platform rules.

19. Intellectual Property

The NIXIVA name, logos, product packaging, website content, graphics, photographs, videos, text, designs, icons, marketing materials, product names, and other brand materials are owned by or licensed to NIXIVA and are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, publish, commercially exploit, or create derivative works from NIXIVA intellectual property without prior written authorization, except where permitted by law.

Nothing in these Terms transfers ownership of NIXIVA intellectual property to you.

20. Third-Party Services

Our website may use or provide access to third-party services, including payment processors, shipping providers, review platforms, social media services, analytics services, marketing platforms, and other technologies.

Third-party services are provided by their respective providers and may be subject to separate terms and privacy policies.

We are not responsible for the operation of independent third-party websites or services except to the extent required by applicable law.

21. Third-Party Links

Our website may contain links to third-party websites.

Providing a link does not necessarily constitute endorsement of the third party.

We encourage you to review the terms and privacy practices of third-party websites before purchasing products or providing personal information through them.

22. Website Accuracy

We attempt to provide accurate and current information, but our website may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors.

These may relate to product descriptions, pricing, promotions, availability, shipping, photographs, or other information.

We reserve the right to correct errors and update information as reasonably necessary.

23. Availability of Services

We do not guarantee that our website or Services will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, discontinue, or restrict all or part of the Services when reasonably necessary.

24. Prohibited Uses

You may not use our website or Services to:

  • Violate applicable laws or regulations.

  • Infringe intellectual-property rights.

  • Submit knowingly false or misleading information.

  • Transmit malware, viruses, or malicious code.

  • Attempt unauthorized access to our systems.

  • Engage in fraud or payment abuse.

  • Manipulate promotions, referrals, reviews, or affiliate systems.

  • Harass or harm others.

  • Interfere with the security or operation of our Services.

  • Use NIXIVA branding without authorization.

We may restrict access or cancel orders associated with prohibited activity where permitted by law.

Our collection, use, disclosure, and handling of personal information is described in our separate Privacy Policy.

By using our Services, you acknowledge that personal information may be processed as described in that policy and as otherwise permitted by applicable law.

26. SMS & Email Marketing

If you voluntarily subscribe to marketing emails or text messages, we may send promotional communications according to your consent and applicable law.

Consent to marketing is not required as a condition of purchasing NIXIVA products.

You may unsubscribe from marketing emails using the unsubscribe mechanism included in the communication.

SMS programs, if offered, may be subject to additional terms.

Transactional communications relating to purchases, account activity, shipping, security, or customer service may still be sent when appropriate.

27. Subscribtions

NIXIVA may offer a Subscribe & Save option on eligible products. Subscribe & Save allows customers to receive a discount on eligible products in exchange for enrolling in recurring automatic deliveries and payments.

Subscription Frequency

When enrolling in Subscribe & Save, you may select from available delivery frequencies, which may include:

  • Every 2 weeks

  • Every 4 weeks

  • Every 6 weeks

Available frequencies may vary by product and may be changed or discontinued for future subscriptions.

Subscription Discount

Subscribe & Save customers receive the discount displayed on the applicable product page or during checkout at the time of enrollment.

Subscription discounts apply only to eligible subscription products and may not be combined with certain other discounts, promotions, or offers unless otherwise stated.

NIXIVA may change the Subscribe & Save discount offered to new subscribers at any time. If a change will affect an existing subscription, we will provide notice when required by applicable law.

Automatic Renewal & Billing

By enrolling in Subscribe & Save, you authorize NIXIVA and its payment providers to automatically charge your selected payment method for each recurring subscription order according to the delivery frequency you selected.

Your subscription will automatically renew and continue until you cancel it.

The amount charged for each recurring order will generally include the applicable product price after your subscription discount, plus shipping and applicable taxes, if any.

You are responsible for maintaining a valid payment method for your subscription.

Recurring Shipments

Subscription products will automatically be prepared for shipment according to your selected schedule.

Selecting a 2-, 4-, or 6-week frequency establishes the approximate interval between recurring orders. Actual shipment or delivery dates may vary slightly because of weekends, holidays, payment processing, carrier delays, inventory availability, or other circumstances.

Managing Your Subscription

Where available through your customer account or subscription management portal, you may be able to:

  • Change your delivery frequency

  • Skip an upcoming shipment

  • Change eligible products or quantities

  • Update your shipping address

  • Update your payment method

  • Pause your subscription

  • Cancel your subscription

Available subscription-management features may depend on the subscription service used by NIXIVA.

Cancellation

There is no long-term commitment. You may cancel your Subscribe & Save subscription at any time before your next subscription order has been processed.

Once a recurring order has been processed or entered fulfillment, we cannot guarantee that it can be canceled, modified, or refunded.

Canceling a subscription stops future recurring orders. It does not automatically cancel an order that has already been processed.

Skipping or Changing an Order

If you need to skip an upcoming shipment or make changes to your subscription, you must make the change before the upcoming order is processed.

Changes made after an order has entered processing may apply only to subsequent subscription orders.

Pricing Changes

Product prices may change from time to time.

If the price of a product included in an existing subscription changes, we will provide any notice required by applicable law before charging the new amount.

The subscription discount applicable to your order will be calculated according to the terms of your subscription and any applicable promotional conditions.

Out-of-Stock or Discontinued Products

If a subscription product becomes temporarily unavailable, we may delay or skip the affected shipment.

If a product is permanently discontinued, we may cancel the affected subscription or contact you regarding available alternatives.

We will not substitute a materially different product without authorization where consent is required.

Failed Payments

If we are unable to process your recurring payment, we or our subscription provider may attempt to process the payment again and/or contact you to update your payment information.

Your subscription shipment may be delayed or canceled until successful payment is received.

Repeated payment failures may result in suspension or cancellation of the subscription.

Shipping

Subscription orders are subject to the same shipping terms described in our Shipping Policy, including applicable shipping charges, processing times, address requirements, carrier delays, and delivery terms.

Any free-shipping threshold or promotion applies to subscription orders only when expressly stated.

Returns & Refunds

Subscription purchases are subject to our Return & Refund Policy.

Canceling your subscription does not automatically entitle you to a refund for products that have already been processed, shipped, or delivered.

Promotional Subscription Offers

From time to time, NIXIVA may offer special introductory subscription discounts or other Subscribe & Save promotions.

Promotional offers may have separate eligibility requirements, expiration dates, minimum subscription periods where legally permitted and clearly disclosed, or other conditions displayed when the offer is presented.

Subscription Communications

By enrolling in Subscribe & Save, you agree that NIXIVA and its subscription service providers may send transactional communications necessary to administer your subscription, including upcoming order reminders, payment notifications, shipment confirmations, failed payment notices, subscription changes, and cancellation confirmations.

These transactional messages are separate from optional marketing communications.

Your Responsibility

You are responsible for reviewing your subscription information and keeping your shipping address, payment information, product selections, and delivery preferences current.

If your information changes, please update your subscription before your next order is processed.

Subscription Terms Presented at Checkout

Additional subscription terms, pricing, discounts, renewal disclosures, and cancellation information may be displayed when you enroll in Subscribe & Save.

Those terms are incorporated into these Terms of Service. If there is a conflict regarding a specific subscription transaction, the subscription terms clearly presented to you at the time of enrollment will apply to that transaction to the extent required by applicable law.

28. Resale

Unless expressly authorized by NIXIVA, purchasing products from our retail website does not automatically authorize you to act as an authorized NIXIVA retailer, distributor, wholesaler, or reseller.

Wholesale and resale relationships may be subject to separate agreements and requirements.

29. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and Services are provided on an “as is” and “as available” basis.

Except for warranties that cannot legally be excluded, NIXIVA disclaims implied warranties to the extent permitted by applicable law.

Nothing in these Terms is intended to waive or limit rights that cannot lawfully be waived or limited.

30. Limitation of Liability

To the fullest extent permitted by applicable law, NIXIVA and its owners, officers, employees, affiliates, representatives, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

31. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless NIXIVA and its applicable owners, officers, employees, affiliates, and representatives from third-party claims, damages, liabilities, and reasonable expenses arising from your material violation of these Terms, misuse of the Services, infringement of another person's rights, or unlawful conduct.

32. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will continue in effect.

33. Waiver

Our failure to enforce a provision of these Terms does not constitute a permanent waiver of that provision or our right to enforce it later.

34. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, Affiliate Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement governing your use of the applicable NIXIVA Services.

If additional terms apply to a particular promotion, subscription, affiliate relationship, or service, those additional terms will also apply to that activity.

35. Changes to These Terms

We may update these Terms from time to time.

The most current version will be posted on this page with an updated “Last Updated” date.

Where required by law, we will provide additional notice or obtain consent before material changes take effect.

Your continued use of our Services following an effective update constitutes acceptance to the extent permitted by applicable law.

36. Governing Law

These Terms and disputes relating to them will be governed by applicable laws of the State of Florida, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
